I don't think the Star Spangled Banner is still under copyright protection.
The best way to find out (cheaply_ is to look at the sheet mysic for the song, and see if there is a copyright notation on it. Or contact the copyright office and ask them. The copyright office has a web site, with contact info. Maybe you can just call them and ask them.
